1. Privacy Statment

We, the Shamyieh Reiser Rechtsanwälte GmbH, collect only those personal data that are necessary for the performance and administration of our legal services, or that you have voluntarily provided to us

We process and use your personal data only with your consent, mandate, or order, for the purposes agreed with you, or where there is another legal basis in accordance with the GDPR. This is done in compliance with applicable data protection and civil law provisions.

Personal data includes any information relating to an identified or identifiable individual, such as name, address, email address, telephone number, date of birth, age, gender, social security number, video recordings, photographs, voice recordings, and biometric data such as fingerprints. This may also include sensitive data, such as health information or data related to criminal proceedings.

2. Right to Access and Deletion

As a client or, more generally, as a data subject, you have the right — subject to attorney-client confidentiality — to request information at any time about your personal data that we hold, including its origin, recipients, and the purpose of processing. You also have the right to request correction, data transfer, objection, restriction of processing, and the blocking or deletion of inaccurate or unlawfully processed data.

If there are any changes to your personal data, we kindly ask that you inform us accordingly.

You have the right to withdraw your consent to the use of your personal data at any time. Requests for access, deletion, correction, objection, and/or data transfer (unless it would involve an unreasonable effort) can be directed to the law firm at the address provided in Section 10 of this statement.

If you believe that the processing of your personal data by us is in violation of applicable data protection laws, or that your data protection rights have been otherwise infringed upon, you have the right to file a complaint with the relevant supervisory authority. In Austria, the responsible authority is the Data Protection Authority.

3. Data Security

The protection of your personal data is ensured through appropriate organizational and technical measures. These measures specifically address the protection against unauthorized, unlawful, or accidental access, processing, loss, use, and manipulation of data.

Despite our efforts to maintain a consistently high level of diligence, we cannot guarantee that information you provide to us over the internet will not be accessed or used by unauthorized parties.

Please note that, as such, we cannot assume any liability for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (e.g., hacking of email accounts, interception of faxes).

4. Use of Data

We will not process the data provided to us for any purposes other than those covered by the mandate agreement, your consent, or any other provision in accordance with the GDPR. An exception to this is the use of data for statistical purposes, provided the data has been anonymized.

5. Transfer of Data to Third Parties

To carry out your instructions, it may be necessary to share your data with third parties (e.g., the opposing party, substitutes, insurers, service providers we engage and share data with, etc.), courts, or authorities. Your data will only be transferred in accordance with the GDPR, specifically for the fulfillment of your mandate or based on your prior consent.

Additionally, we want to inform you that, as part of our legal representation and support, we regularly obtain factual and case-specific information about you from third parties.

Some of the recipients of your personal data mentioned above may be located outside your country or may process your personal data in other countries. The level of data protection in these countries may not meet Austrian standards. However, we will only transfer your personal data to countries that the European Commission has recognized as providing an adequate level of data protection, or we will implement measures to ensure that all recipients uphold an adequate level of data protection, including the use of Standard Contractual Clauses (2010/87/EC and/or 2004/915/EC).

6. Cookie Consent Tool Based on Usercentrics Technology

This website uses a cookie consent tool powered by "Cookie Script" technology (hereinafter referred to as "Cookie Script") to obtain valid user consent for cookies and cookie-based applications that require approval.

When users visit the site, a banner is displayed via embedded JavaScript code, allowing them to grant consent for specific cookies and/or cookie-based applications by checking the appropriate boxes. The tool prevents any cookies that require consent from being set until the user has provided the necessary approval by ticking the boxes. This ensures that such cookies are only placed on the user's device if consent is given.

In order for the cookie consent tool to properly track page views, record and store the user's consent preferences for the duration of the session, certain user information (including the IP address) is collected when you access our website. This data is transmitted to servers of Usercentrics and stored there.

These data processing activities are carried out in accordance with Article 6(1)(f) of the GDPR, based on our legitimate interest in ensuring legally compliant, user-specific, and user-friendly consent management for cookies, thus ensuring the legal compliance of our online presence.

An additional legal basis for the described data processing activities is Article 6(1)(c) of the GDPR. As data controllers, we are legally required to make the use of technically unnecessary cookies dependent on user consent.

7. Google reCAPTCHA

This website also uses the reCAPTCHA feature provided by Google Ireland Limited, located at Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"). This feature helps distinguish whether an input is made by a human or is the result of automated, machine-based processing. To facilitate this, the service collects and sends the IP address, along with any other data necessary for reCAPTCHA, to Google. This data processing is carried out in accordance with Article 6(1)(f) of the GDPR, based on our legitimate interest in verifying user authenticity and preventing abuse and spam. As part of using Google reCAPTCHA, personal data may also be transferred to the servers of Google LLC in the USA.

8. Google Maps

We use Google Maps (API) on our website, provided by Google Ireland Limited, located at Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"). Google Maps is a web service that displays interactive maps, allowing geographical information to be presented visually. By using this service, your location is shown, and directions may be provided.

When you visit pages that include the embedded Google Maps, information about your use of our website (such as your IP address) is sent to Google's servers and stored there. This may also involve a transfer of data to the servers of Google LLC in the USA. This occurs regardless of whether you are logged into a Google account or have an account at all. If you are logged into Google, your data will be directly associated with your account. If you prefer not to have your data linked to your Google profile, you must log out before activating the service. Google stores your data (even if you are not logged in) as usage profiles and analyses it. The collection, storage, and analysis of this data are carried out in accordance with Article 6(1)(f) of the GDPR, based on Google’s legitimate interest in displaying personalized ads, conducting market research, and/or customizing Google websites to meet users' needs. You have the right to object to the creation of these user profiles, and to exercise this right, you must contact Google. If you disagree with the future transmission of your data to Google in connection with Google Maps, you can also choose to completely disable the Google Maps service by deactivating JavaScript in your browser. In this case, Google Maps and the map display on this website will no longer be available.
